ESTABLISH FACTS

Don't assume that everyone is aware of the fact. Even if you think they do, put your version of events in writing so you have a record of what happened in case you need to go to court. It ought to give enough background information so that someone who is not familiar with the circumstances can comprehend what took place. Your efforts to resolve the conflict should be included in the facts. cite any emails, discussions, or other written or verbal communications that show that going to court is a last resort.

REFER TO EVIDENCE

Mention any supporting documentation if the recipient is in possession of it. Evidence destruction is prohibited, but that doesn't imply it doesn't take place. You will be in a better position to defend your position in court if you are more specific about the proof, how you know the receiver has it or controls it, and why it is significant.

MAKE A DEMAND

SET A DEADLINE AND ESTABLISH METHOD OF PAYMENT

OFFER A CONSEQUENCE

Tell the receiver specifically what you plan to do if your demands are not satisfied (i.e., file a lawsuit). It's okay to inform the other party that you'll launch a lawsuit if your demands aren't met. Any of the other kinds of threats are not applicable, please don't use them.
